Do I have to have an Owner's Title Insurance Policy?

A home is typically one of the largest assets you will purchase in your life time.  At your closing you will be essentially “taking title” to the home and the land.  You will want to be certain that the title is free of defects.

Some of these defects are as follows:

  • Other entities that claim ownership interest in the property.
  • Challenges of ownership interest in past sales transactions.
  • Interests of spouses.
  • Property Liens.
  • Unpaid Creditors.
  • Forged documents. 
  • Clerical error on previously recorded legal documents.
  • Incorrect or incomplete legal descriptions.
  • Documents signed by minors or mentally incompetent persons.
  • Title issues resulting from probated will.

These are a few of the items that are covered by a Standard Owner's Title Insurance Policy.  Please make sure that you carefully review your Real Estate Contract so that you understand the type of policy that is required in your contract and if there are any exclusions to this policy.
